Research On Industrial Injury Insurance For Migrant Workers In China

Migrant workers are special labor groups in the period of socialist transformation in China,and they are also the main force in urbanization construction and modernization.However,due to restrictions on household registration and capacity,migrant workers are mostly engaged in labor-intensive industries such as construction,manufacturing and service industries.They are difficult,labor-intensive,and have long working hours.There are also many safety risks,and work-related injuries are more frequent.Therefore,the peasant work is a vulnerable group in the modern laborer group,and targeted work injury protection is of paramount importance.China's labor injury insurance legal system was officially formed in 1996,but as of now,high-risk migrant workers still can not enjoy the same work-related injury insurance as urban workers,and there are still many problems in the legal system of migrant workers' injury insurance.Based on this,this paper takes the legal system of migrant workers' injury insurance in China as the focus,and sorts out the practical problems existing in the legal system of migrant workers' injury insurance in China.The main problems are the low coverage of industrial injury insurance,the cumbersome work injury identification procedure,and the difficulty in confirming labor relations and work injury treatment.Difficulties in implementation and inadequate mechanisms for prevention and rehabilitation of work injuries.Then,starting from these problems,from the four aspects of legal norms,administrative supervision,enterprises and migrant workers themselves,the reasons for the legal system of migrant workers' industrial injury insurance are analyzed.The main problems are that the legal system of migrant workers' injury insurance is not perfect,and the labor inspection department is working injury.The lack of insurance supervision responsibility,the non-standardization of enterprise employment and the evasion of social security obligations and the awareness of migrant workers' own work-related injury insurance.Establishing and improving the legal system for migrant workers' injury insurance is not only a requirement of China's constitution and laws,but also a realistic requirement for low participation rate of migrant workers' industrial injury insurance and difficulty in obtaining compensation for work-related injuries after work-related injuries.Finally,the countermeasures for perfecting the legal system of migrant workers' industrial injury insurance in China are put forward in a targeted manner.Special laws and regulations should be established,labor supervision should be strengthened,media and other social forces should be introduced,and work injury insurance knowledge training should be carried out to fundamentally safeguard Chinese farmers.The legitimate rights and interests of the industrial groups will build a fair,just and harmonious socialist society.
