Can a person for whose benefit a contract is made, but who is not himself the promisee and who did not give any consideration, maintain any form of action against the promisor for breach of contract? Does society recognize that he has any rights and enforce them at his request? This article tries to answer these questions. Chapter I : The privity of contract is an important principle, however, as the cases of contracts for the benefit of third persons turn up, it is not abided by as before. Chapter II : Expound the conception of contract for the benefit of third person, the relationship of the parties of contract, and introduce main types of contracts for the benefit of third persons, such as trust, insurance, transportation. Chapter III Expound rights and obligations of the parties of the contract for the benefit of third person, and try to find the reason for why the third person can maintain some form of actions against the promisor. Chapter IV: Fist, sum up the new developments of contracts for the benefit of third persons. The second, introduce the present conditions of our law and jurisdictions, and then raise some propositions for the law of ntract.
