This article is about risk liability. First, It approaches the basic theory of the subject from different angles including it's concept functiorn exemption causes and shared risk liability. Second, It inspects the different legislation model, and points out their advantage and disadvantage. Third , It probes the awkward situation of risk liability in the tort laws and thinks it's real home should be social security law system. At last in view of the defect of our country's legislation, This article gives it's own suggestion.
