Worker Dispatching Law Research

Worker dispatch is a new type of labor, which developed rapidly in recent years in China. But in practice, there are some problems that constraint worker dispatch healthy development. Although the new "Labor Contract Law" has made special provisions for a separate section, but there are still imperfections pending further study.Worker dispatch was originated in the early 20th century the United States, and developed in Europe, Japan. Because of its flexibility, and low cost advantage it has been adopted by most countries in the world. Workers dispatch involved in the dispatch units, the dispatched workers and the employers. And its most notable feature is the separation of the labor employment and the use. A correct understanding of their legal relations is the key to inhibit its negative effects and set up the relevant system. Hence, I agree with the idea that "one labor relation with two employers."To regulate the worker dispatch and overcome the deficiencies in the current system, China should be enacted the "Workers Dispatch Law" as soon as possible. The law should make the details requirements in the access of dispatch market, labor rights protection, employer's liability and so on.
