On The Economy After China's Accession To The Wto Legal Adaptation

China, as a member in the World Trade Organization, must obey the trade rules fixed in the WTO agreements, and fulfill its obligations. Otherwise, China won' t only lose all the facilities and reciprocal treatments offered by the other WTO members in fields of trade, investment and so on, but even also suffer the arbitrations for the disputes in the international businesses. The paper first talks about the five basic principles, the principle of most favored nation treatment, the principle of national treatment, transparent principle, market admittance principle and the principle of exception, which work in the international businesses. Following that it dissects in detail the incongruity between the spirit of WTO agreements and China' s economic laws and regulations in three main fields involved in the agreements, of trade (including goods and services), investment and the protection of the intellectual properties, and presented how to adjust the incongruities. Next, the paper analyzes the adjustment of our country' s other economic laws beyond the three main fields, including anti-unfair competition law, anti-trust law, security law, the law of corporation, partnership law, enterprise bankrupt law and taxation law system. At last, the study is also made to other aspects that needed paying attention to after China joined the WTO and started its adjustment of the economic laws. The paper isn' t satisfied with the incongruity between the regulations of WTO agreements and the economic laws in China; on the contrary, it points out the existing drawback of the systems of law and presents an idea of the resolution in the spirit of WTO agreements. Furthermore, it wishes China could really melt itself into the global economy. The paper presents some new ideas such as the comprehension of WTO basic principles, the principle of exception, and some factors of adjustment and so on.
