| Judge is the key person who exerts jurisdiction, then assigns right in reason and realizes the society order. However, the construction of our country's judge system began late and didn't get fully recognition. With the modernization of justice, the judge's modernization has been paid attention to, and how to construct modern judge system to ensure the realization of law's modernization has become very important, so the study about this question inside and outside of our country gets active and abundance gradually. Joined together with the successful experience of the foreign judge system developments and the judicatory fulfillment of our country, this document tallies up that the basic characteristics of the modern judge system of our country should be the judge becoming more professional, independent and excellent. But this text aho analyzes that many problems exist in the current constructing process of our country's judge troop, such as the judge not being highly professional, the judge's independent position not having been realized yet for all kinds of reason, and the problem of the judge troop not being very excellent needs to be solve eagerly too. Subsequently, based on coming up with the questions and analyzing the questions, the author thinks in order to build our country's modem judge system, we should put great emphasis on beginning to make the judges become more professional, independent and excellent, let the judges get their independent status, reform the selecting system of the judge, control the scale of the judge troop strictly to make sure that the law professional personnel with high character can enter the judicial realm, and then realize the justice and efficiency of the judicatory. At the same time, we still need consummate the judge's training system, guaranteeing system, punishing system , occupation moral system and other related system to insure the judges keep the resolute law religions and realize the value of the judicatory with the modern law ideas. |
