Explore On The System Of Judge Trial Responsibility Exemption In China

Under the background of the current judicial reform in China,the judicial responsibility system is the highlight of the judicial reform.In recent years,because the central government has intensified its efforts to combat judicial corruption and a series of relevant documents have been issued for the accountable judges,China has formed a judicial responsibility system with the main content of misjudged case investigation,but there are many questions about the misjudged case investigation system.In practice,there is no standard for the accountability of judges,the in dependence of judges is eroded,and the phenomenon of "collective running away" directly affects the judicial power of our nation.Therefore,the establishment of a complete system of immunity from the responsibility of judges is of practical significance for safeguarding the in dependence of judges in trial and remedying the loopholes in the investigation of misjudged cases.Therefore,through the theoretical analysis of the immunity system of judges' responsibility,combined with the current judicial situation in China,this paper investigates the development and formation of the immunity system of judges' responsibility in the West,analyses the problems of the immunity system of judges' responsibility in China,makes a comparative study and draws lessons from the design concept of the immunity system of judges' responsibility in mature countries,and puts forward the construction of the system.It is necessary to establish and perfect the system of judges' liability exemption in China.
