With the under-reforming basic medical insurance system in urban and rural areas as its objective, this thesis made comparisons and researches on problems of the Basic Medical Insurance (BMI) system such as the objectives of insurance, capital collecting system, managing system etc. Divided into 4 parts, the thesis is developed in 2 aspects: the foreign countries' practice of the BMI system and the development of China' s BMI system in urban and rural areas.Part 1. Firstly, this part gives a clear scope on the concept of BMI discussed in the thesis by analyzing its signification, its features and the difference between BMI and relevant social insurance (SI) system. Secondly, it explained the legitimization of China' s practice of BMI system in points of views including human rights protection, ineffectiveness of the market in the medical field, justice of the society etc. After that, an analysis is made on the characteristics, advantages and disadvantages of 4 BMI types in the world in order to draw the conclusion that China should choose the mode of social insurance for its BMI system. Finally, after analyzing the inheritance of China' s BMI system in urban and rural areas, several law-relevant problems, such as the objectives and managing system of BMI, are proposed for current reform in this field.Part 2. In this part, the question on the objective of China' s BMI system in urban and rural areas is discussed in the aspect of laws and regulations. Based on a brief summary of the objectives of the 4 above-mentioned BMI types, the writer describes some personal ideas on whether the special groups like employees of rural enterprises, rural-origin laborers, retired workers and crippled soldiers should be included into the BMI system.Part 3.This part focuses on law problems in capital collection of the BMI system. Through analysis on the reasons why China should apply the BMI system by financial supporting from the state, the company and the laborer and comparisons of 3 different capital collecting modes, the writer suggests that China should abolish the current social unified and personal account system and carry out sole social unified account system.Part 4. The writer bases his study on law problems on service and management of BMI system in urban and rural areas in this part. Therefore the writer firstly explains that China' s traditional BMI system cannot meet the needs of the market economy system, and then he lays a theory basis for the more appropriate BMI mode and system. Secondly, a further discussion is made on how to make full use of the limited medical and sanitary resources for better social service based on the medical service practice in other countries.
