Obviously, the state apparatus is anexistence of a nation and an important formalization content of a country's politicaland economic systCm. Currently our country is canying out a fiJ1l range institutionalreform aiming at gradual establishmeflt of a satisfactory state aPparatus syStemmeeting the requirements of socialist market economy. Therefore, in given historicaIcircumstances, the study of the theory of constitlltional state apparatus has a practicalsignificance. As an important part of the state apparatUs, the courts must be suitablyreformed. Focusing on the refOrm of coUrts, there are various schools of thought andsuggestions. So fat, these have not been reconciled. The problem needs further stUdyand research to reach a consensus.
