On Administration By Law And Administrative Procedure

The administration according to the laws is the core and thecrux of govening our country according the laws. In order to make China be governed according to the laws thoroughly, it is the foundation and guarantee that the government functionaries in the administrative departments handling affairs abiding by the laws,but in fact at present ,some of them cannot do it,especially the administrative programme cannot be abided by. In this article,the author approaches the influence of the administrative programmes to the administration according the laws and how to realize itThe article consists of four parts:In Part 1 .the author introduces as the following: the concepts ,the classifies and the law values of the administritive progrommes.At first the classification of the adiministrative programme is interpreted carefully.Secondly,the author analyzes the important value of the administrative programme and points out the disobedience to the administrative programmes is the most important elements in inflencing administration according to the laws at present. The above lays the guoundwork for the discussion about the administrative programmes influcencing the administration according the laws for the theme of the article.In Part 2.the author expounds the connection between the administrative programme and the administration according to the laws. At first,the author starts to analyze the cord and the concepts of administration by laws in order to clarify the depths of the connection between the administrative programme and the administration to the laws through understanding the laws and sums up the specific manifestations of disobediencing the administrative programmes. At the mean while, the author analyzes the influence of the administrative programme to the administration to the laws in both positive and negative factors, so the author expresses the importance of the administrative progromme to the administration to the laws. At last the scientific conclusion is made that the administrative programmes must be abided by while the administration is according to the laws.In Part 3.the author analyzes the ways to administration to the laws.There are three theories opinions.Firstly.the author points out the presupposition of administation to the laws is that there are the laws to be abided by.and clarifies the laws concerned which must be the fine laws both in its substance and in forms and makes a concrete analysis of the contents of the laws.Secondly,the influencing elements of the obstacles are researched.For example, democratic administration, power control.administration opening and the shortcomings of the administratic laws,ect. Thirdly,the author lists the main problems in the administration according to the laws at present and makes some instructive suggestions for prelecting the administration to the law.especially,from the measures to realize the administration according to the laws.In Part 4.The author analyzes the ways to improving the levels on the administration according to the laws, which is that the programme must be respected and abided by.From theangle of making the progress in making code of the laws in China and in the foreign countries,the theorical opinion is made that the modles,the princeples and the working steps are the life of the laws,and abiding by the administration programme is to abide by the administration according to the laws. In the analyzation of the last part, the theme is quite clear that the administration programmes occupy a pivotal position in administration according to the laws.
