Construction And Perfection Of Legal System Of Insurance Brokers

As one of the insurance intermediary, insurance broker plays an important role in insurance market. Recently, the research on the legal system of insurance broker draws the attention from people of all walks of life. Certain achievement has been got in the respect of insurance broker legislation. However, in a word, the theoretical research still can't satisfy the need of the development of insurance market. Thesis herein proposes some concrete measures about perfecting the system of insurance broker in China, by analyzing the system of insurance broker in developed countries and areas such as America, England and so on. Through learning from foreign countries and drawing on their advanced experiences, and thinking about the situation of China, I am expected to do something to perfect the system of insurance broker in China, to provide some valuable reference materials for the theoretical circles to research the system of insurance intermediary, to help insurance clerks, especially the insurance intermediary correctly recognize and voluntarily standardize market activities.The thesis herein is composed of four chapters. The first chapter mainly inquires into the definition and connotation of insurance broker, and analyses the connection and difference between insurance broker, insurance agent and other brokers, sets forth the legal position and legal functions of insurance broker in the socialist market economy.The second chapter probes the reasons for comparatively perfect system of insurance broker in such countries and areas as America, England, Australia. Germany, Japan, Taiwan, Hong Kong by comparing and analyzing the system of insurance broker in these countries and areas, to learn the advanced experiences.The third chapter reviews the history of the development of the system of insurance broker in China, and comments on the present situation and causes of the development of insurance broker, finds out the international gap of the system of insurance broker in our country. On the other hand, if we treat this problem in long term and we'll believe that the insurance broker possesses a bright prospect.The fourth chapter proposes the concrete measures to establish and perfect the system of insurance broker; to further perfect the supervision system of insurancebroker; perfect the professional liability insurance system; to promote the insurance provisions and insurance premium rate marketing; to quickly perfect relevant law and regulations; to carry out scientific system of qualification rank and difference commission; to perfect the supervision to foreign insurance broker company.
