China's access to WTO has brought millions of new problem and challenge to the supervision of foreign banks. As to china, used to be in need of a consummate legal system on supervising foreign banks, it is an urgent historical topic to reinforce and perfect the supervision of foreign banks. Herein, this article has carried out a systematically study over the issue that Chinese counter measures and problems waiting for solving about Chinese supervision of foreign banks in the situation of WTO.To expound the supervision of foreign banks, firstly, its necessity should be analyzed the historical and modern cut. This article, taking the initiating and developing of foreign bank as the main thread, digs into the necessity of strengthening the supervision of foreign banks under WTO, and analyzes the new challenges we are to face to supervise of foreign banks.After the study of these challenges through macro perspective, it is theoretically inevitable to research them through legal angle. The second chapter analyzes the existing international legislation of foreign bank deliberately. It studies mainly the influence and requisites the law of financial service trade has exerted on China. It also studies deeply the specific influence on banking caused by the principle of market access, principle of national treatment, principle of most-favored nation, principle of transparence, and principle of gradual freedom; hereafter, it states the Basle Accord's principle and requirements of supervision of national bank.It is a logic elongation of theoretic study to analyze, initiating from the requirements of foreign legislation, the correlative relation betweenthe internal legislation and these requirements. Thereafter, the third chapter states briefly the legal system of our supervision of foreign bank, and its main contends. Moreover, it criticizes and examines our existing condition of supervision of foreign bank, and it points out the problem and loopholes by study through macro perspective and micro perspective.The life of theoretic study lies in the counter measures of practice it gave. This article, based on the study over the problem stated above, put forwards its correspondent solving measure of how to perfect our supervision of foreign bank, which are: macroscopicly, erecting the principle of supervision of foreign bank, specifying the goal of supervision of foreign bank;and microcosmicly, reinforcing the everyday supervision after the foreign bank's entry, building an overall system of deposit insurance, erecting a regulated system of information exposure.
