Study Of Basic Problems Of The Administrative Body

With the administrative litigation law being brought into effect, and for there being superiorities of the theory of litigation subject to the theory of administrative institution and department, the definition of administrative subject was imported to our country and came into being the theory of administrative subject with our own features. It is no doubt that it is the learning research and the practice of justice that boost the development of the theory of administrative subject in our country. For the change of economical conditions, the theory of administrative subject seemed to have too many problems to deal with especially in these days when the administrative litigation have brought into effect for many years. Because the original aim of pragmatism can't form the headspring of power that could not ensure the constant development, the theory of administrative subject was oppugned and observer by more and more scholars. In this paper, we will review all these basic problems of administrative subject and make my own choice between patching the leaks under practical conditions and founding a new and a valuable theory system.There are five parts in this paper:Part One Introduction:In this part, we introduce the reason, importance, the writing purpose and the whole frame.Part Two Summarize Of administrative Subject:In mis part, firstly, we introduce the background and importance of the origin of administrative subject. Secondly, after reviewing different kinds of definitions of adrninistrative subject in different countries or districts, I bring out my own apprehension to this definition. Last, we introduce the concrete expressive form of administrative subject in our country and the particular kinds of administrative institution and organizations being authorized.Part Three Comparatively Research Of Foreign And Our Country:In this part, firstly we make our research from the point that how the theory of administrative subject comes into being and what is the importance of this theory, then we probe the background of the first stage of the theory of administrative subject. Secondly, by scanning the theories (or system) of administrative subject in different countries or districts, we try to find some characteristics of these theories (or systems), and by comparing them with our own theory, we study to find the difference between them.Part Four Predicament Of theory of administrative subj ect nowadays:Our own theory of administrative subject faces lots of challenge form scholars. After introducing, analyzing, and appraising, I express my own opinion to these limitations.Part Five Expectation to the Development of Theory Of administrative SubjectIn this part, we firstly review and analyze the opinions and thoughts the scholars at home have made on the topic of expectation to the future development of theory of administrative subject .Then we introduce the definition-, development of the non-governmental organizations and my own opinions on the intending development of the theory of administrative subject.
