Insurance Services Trade In The Mechanism Of The Wto Legal System Construction Research

The paper falls into four parts with more than 50,000 words besides preface.The first part introduces the definition of insurance trade in services and the development circumstances, background and trends of world insurance trade in services, indicating that the insurance trade in services shall realize inevitable liberalization in the whole world.The second part is about the legal basis of insurance trade in services under WTO mechanism. This section introduces two important legal documents which regulate insurance trade in services under WTO structure, GENERAL AGREEMENT ON TRADE IN SERVICES and AGREEMENT ON FINANCIAL SERVICES, commenting in detail on six principles pervading GATS combining with insurance trade in services: most-favoured-nation treatment, national treatment, transparency, increasing participation of developing countries, market access as well as progressive liberalization.The third part is about the opportunities and challenges that Chinese insurance trade in services confronts under WTO mechanism. This section describes the present situation of Chinese insurance trade in services and reviews its opening process, analyzing and revealing the content of such opportunities and challenges.The fourth part is about the studies on the legal system constructing of Chinese insurance trade in services. From the point of view of coping with WTO rules, this section discusses and probes legal system constructing of Chinese insurance trade in services from six aspects undermentioned: corporation management system constructing of stated-owned insurance company; insurance watch system constructing; insurance solvency and its watch system; insurance investment watch system; bank-insurance joint management system; regulating and developing Chinese insurance agency market.
