China's Anti-dumping Investigation Agencies And The Judicial Review System To Establish The Rules Of The Wto

Antidumping issue significantly constitutes the international trade. With China's entry into the Word Trade Organization (WTO) and its flourishing in foreign trade, Antidumping investigations will be both widely and increasingly used in China to prevent the dumping of foreign products. However, there's much room for improvements in China's present system of antidumping laws, which primarily concern the readjustment of antidumping investigation agencies and the establishment of the judicial review system of antidumping cases. Therefore, China is pressing for an amendment of antidumping laws in accordance with the basic antidumping principles made by WTO and China's current national conditions.The World Trade Organization Antidumping Agreement (WTOAA) provides WTO member countries a basic theoretical procedures to follow in revising their international antidumping laws. Aiming at producing personal proposals on China's readjustment of antidumping investigation agencies and establishment of the judicial review system of antidumping cases, the thesis falls into five parts as follows:Part Ⅰ mainly concerns the antidumping investigation procedures stipulated in WTOAA, which represents features and significance of antidumping procedures. Hence the vital position of antidumping investigation in antidumping laws well stands out.Part Ⅱ concerns theoretical analysis of establishing the judicial review system of antidumping cases so as to achieve efficiency and independence in judicial system.Part Ⅲ seeks to draw on experience of antidumping law systems of the United States and European Union to serve China's improvements in its antidumping laws.Part Ⅳ deals with effective ways of readjusting China's antidumping investigation agencies; first priority should be given to the coordination and high efficiency of varied agencies.PartV mainly attaches importance to China's ultimate establishment of judicial review system of antidumping cases.
