Parents And Children To Determine The Identity System

This article is written about the system of how to determine the Parentage of the child. First, it introduces this system of France, Swiss, Italy, Japan and Germany. After compare them each other, the author try to express his suggestion on how to perfect the legislation in China. Meanwhile, the author also pay much attention to the Paternity Test because it is very new and important and give some advice to our country too. This treatise is composed of four parts. There are about words in this dissertation.The first part covers the system of how to determine the parentage of the child in brief. It is divided into three section: the relation s between parents and children born in wedlock, the relations between parents and bastard, the relations between parents and AID children.In the second part, the author introduces this system of France, Swiss, Italy, Japan and Germany what lay basis for further development.The third part makes a comparison of the system of the five country in details: France, Swiss, Italy, Japan and Germany . The author compares them from different point of view: the system of legislation, the determine of motherhood, and the determine of paternity, and so on. Besides, some advice also is expressed in this part to perfect the system of how to determine the parentage in China.In the fourth part, the Paternity Test is discussed .As a important method to know the real relation between the parents and child, Paternity Test is accurate enough , especially DNA-test. But there is no law to adjust it. So the author compare the foreign legislation and give some advice to our country.
