On The Third Party System Of Civil Procedure

The third party system is one of the key and difficult systems of litigant of civil litigation, whose purpose is not only to perfect the litigant system, but also to effectively protect the interests of the third party and the litigant. According to the current law of our country, the third party in civil litigation falls into two categories: the third party with independent right to petition, and the third party without the independent right to petition. But such categorization is relatively simple and defective, which requires further improvement. On the basis of comparative study, by introducing the legislation of the third party of litigation in foreign countries and comparing it with that of our country, starting with the categorization of the third party, the thesis discusses the litigation right, confirmation standard, and means of participation into litigation, ect. step by step, and puts forward proposals for amendment and perfection, and thus puts forward the specific proposals for rebuilding the third party system in our country.
