Research On The Third Party’s Participation In The Resolution Of Petition Contradictions

Petition,in a broad sense,means that citizens,legal persons or other organizations reflect information or complaint requests from the public to people’s governments at various levels and their relevant administrative departments through letters,e-mails,visits and other forms.It is an activity organized and handled by the relevant administrative authority according to laws.Petition system is a unique political system of China which has many important functions,such as the expression of interests,social supervision and judicial relief.This system is also an indispensable link in the construction of socialist democratic politics with Chinese characteristics.However,in recent years,as socialist economy with Chinese characteristics develops quickly and citizens have greater awareness of democratic politics,all kinds of social contradictions gradually appear one after another.Therefore,it is basically difficult for China to rely on government departments alone to do a good job in government petition and stabilize social and economic development.The Government Work Report at the18^thCPC National Congress of China also clearly pointed out that“we should speed up the formation of a social management system under the leadership of the CPC central committee,with government departments in charge,social actors in coordination,the participation of the masses and the support of legal guarantee systems so as to build a socialist management system with Chinese characteristics.All ranks and classes should take an active part in the construction and should gradually integrate into the economic and social management so that we can resolve all kinds of social contradictions and build a stable and harmonious society”.This paper makes an in-depth study on the third party’s participation in the resolution of petition contradictions of China by combining theories with practice.Firstly,the paper adopts the literature analysis method to comprehensively analyze the development and reform of China’s complaint reporting management system,which provides theoretical supports for relevant issues studied in this paper.Secondly,this paper uses the questionnaire survey method to conduct in-depth field researches in Y County of China.This paper also does related quantitative and qualitative analyses by analyzing the types of people’s participation in petition,people’s cognition and satisfaction and the progress of the third party’s participation in investigating and handling related petition cases.Besides,this paper finds out specific problems in the third party’s participation in the petition work of China,for example,the evaluation systems are not scientific enough and corresponding policies,laws and regulations are not systematic and perfect enough.On this basis,this paper puts forward some methods and suggestions on improving the third party’s participation in the solution of petition contradictions so that we can better solve complaint reporting puzzles in China.By introducing third-party forces to the resolution of petition contradictions,first,we can give full play to advantages of different fields,make up for the inadequate power of petition organizations and relieve the pressure of petition organizations.Second,the governance cost of the government and the appeal cost of the public can also be greatly reduced.At the same time,the government can handle social conflicts more flexibly.Third,when handling petition cases,third parties can conduct psychological instructions,hold law learning and other activities for petitioners,which can effectively resolve petition contradictions,save judicial resources and maintain judicial authority.Finally,the participation of more social powers in national governance systems will play a crucial role in the communication of more departments,their exchange of information and the modernized governance of China.Therefore,the participation of third-party forces in the petition process is greatly significant to the resolution of petition contradictions and disputes,the development and reform of petition work,the establishment of"sunny"and"responsible"petition"ruled by law"and the construction of a harmonious society.
