| The social security system is the outcome of the modern industry and market economic development, which is one of the important social systems of the country, usually known as the legal system of the social security, to ensure all citizens' rights to existence and development. Objectively, the social security has at least three basic functions that have already formed the common understanding : to ensure human rights, bring about an advance in market economy, safeguard the social fair stability. But how to think about the relation between the three,and by which one of the above three functions as starting point and ultimate purpose to establish and perfect a social security system would surely form different fundamental concepts of the social security system and put up different opinions on the value of the social security. In general, the basic value that the social security of our country pursues is efficiency. But the paper thinks that the core value of the social security is just to respect and ensure the rights to human existence and development of all social members, that the benefited subject of primary importance of the social security system is the under- privileged groups of the society and that the chief criterion to evaluate whether a social security is excellent or inferior is only to see in what degrees the social security has realized the right to the social security of the under- privileged groups. In accordance with the above criterion, the paper believes it is the first meaning of the conception on Social Security System to ensure the human rights of all social members, that social security is the overall title of various economically benefited and socialized security systems to all citizens′lives, according to law, carried out by the government and the society through distribution and redistribution of the national income, whose starting point is to realize all citizens′rights to existence and development . By studying the development course of the social security system in the history, the paper intends to show the social security system is always the partner of the market economy, just because the system had performed the function of ensuring human rights from passively at the beginning to actively in the end, had it promoted the development of the market economy to a certain degree in the history.But the paper's emphasis has been paid on the macroscopic problems of China's social security system: according to the criterion of the above concept of human rights by way of studying China's social security system, we can find such main problems have been existing: (1) The legal system for China's social security is stagnant, which has been weakening the realization of the right to social security of all citizens; (2) The right to social security of China's farmers is unreachable, which is the greatest breach of duty of China's social security; (3) The social security on medical treatment has serious hidden dangers to the guarantee of human rights. Hereinafter, the paper has put forward some suggestions: (1) Orient the government's role in the social security according to the human rights criterion; (2) Structure the social security system of the rural area that helps link up in urban rural areas ; (3) Perfect the construct of the great system of China's social security. |
