Macau Construction Works Tender Contract System Research

The setting-up and perfection of the tendering and contract regulation of civil engineering are a great action that makes the construction industry moving towards the modernization of management. Its appearance makes the construction demonstrate vitality. However, because management system and legal system are not perfect, so that this best trade way of construction market receive serious hindrance, thus lost the actual meaning of calling for bid and submit a tender. This paper is arranged for the target of real example with actual operation and system of the tendering and contract regulation of construction industry in Macau. From the administrator's point and from theory to practice, this paper analyzes at the same time the terms of FIDIC which is riper worked in the world, the purchase rule of World Bank and the current operation of the tendering and contract regulation in U.S.A, Japan and Singapore, etc. The advantage of this regulation and its function in civil engineering are affirmed. Utilizing the investigations of the existing problem on development and management of the tendering in China, comparing with difference existing in legal system of the tendering and contract in Macau, it puts forward the problems existing in the tendering and contract management in Macau which need to be solved quickly. In addition, it analyses the unfair match action existing in the tendering and gives some suggestions on how to strength and prefect the tendering and contract regulation.There are six chapters in the main research content of this thesis. Chapter one, introduction, describes the background, purpose and meaning of research. Chapter two, classification, pluses and minuses of the tendering system, explains through analysis the pluses, minuses and characteristic of various kinds of the tendering and contract regulation in the world. Chapter three, summary of the tendering and contract regulation in domestic and international civil engineering, which affirms through the study its international and superiority and explains the development trend in China of this system. Chapter four, study on the tendering and contract regulation in civil engineering of Macau, through analysis, it lists the problems existing on the system of the tendering and contract regulation of Macau. Chapter five, reform study on the tendering and contract regulation in civil engineering of Macau, it explains the countermeasure and the author's suggestion for reform system. Chapter six summarize and look into the distance. The author appears in this thesis all research work and conclusion and points out the questions that remain to be deeply discussed and put into practice.The main conclusion of studying in this thesis: (1) The system that bid and submit a tender must set up at principles of "Fair, Just, Make public". (2) Enhancement and perfection of the legal construction can guarantee the above mentioned principles putting into practice. (3) Succeed in carrying out scientific management can realize the legalization of manage relation, modernization of manage duty and job license, that can reform the manage system of the tendering in civil engineering of Macau. (4) The important condition of the successful offailure activity of tendering in Macau is to set up perfect management system for supervising construction project. (5) The key factor that the level of building trade and market competitiveness improve is the quality of improving construction employee.
