Study Of Administrative Punishment

Administrative punishment plays an important role in the administration. The establishment and the implementation of the administrative punishment are key factors in the legislation. They are widely mentioned in the legislative regulations concerning the basic principles, establishment of the rights of punishment, the subject of punishment, procedure of the punishment and responsibilities in the law and so on. In reality, the citizen's rights are seriously ruined by the unlawful. Punishment behaviors in the practice of administration, which spoils the image of our govern,nent, destroys the authority of the law and causes some problems of stability.In this paper, it tries to make a systematic analysis of the current issues and their causes in the execution of the administrative punishment. It also provides some measures and suggestion to improve the legislation, social environment and execution of the law, which are in the attempt of solving the problems caused by the illegal punishment, and trying to maintain administrative punishment's positive role in protecting the citizen's rights.There are three chapters in this paper: in the first chapter, it analyzes the role of the administrative punishment. As a punitive administrative behavior, it plays an important role in preventing crimes and punishing the illegal behaviors, and effectively protects the rights of citizen and organization. In the second chapter, it analyzes the current problems and their causes in the implementation of the administrative punishment, and points out the problems in the establishment and the application of the administrative of the subject and right of the punishment. In the third chapter, it discusses the possible measures to regulate the punishment behavior.After a comprehensive analysis in social environment legislation, execution of the law, the paper aims at promoting the democratization of the administrative punishment and the realization of the goals of administrating lawfully.
