In the world, bribery, a kind of social malignant tumour, exists obstinately during the running process of social power.Even now bribery is seriously hindering the social reform and advancement, shaking the authoritative cornerstone of the state -- the law, threatening the stability of state power, disintegrating the national economic strength,weakening the demonstrative function of education, and leading to various crises of social ethics. At all times and in all lands, to punish the committing officials is the most important way to combat bribery. This paper is divided into three parts: preface, main body, and concluding remarks. The preface begins with the history of bribery in our country.Through vertical and horizontal comparison, the paper states briefly the developments and present condition of bribery.It points out that bribery has become one of the biggest chronic and stubborn social diseases.It explains in detail the serious harmfulness of bribery.Combined with working experience,taking human being as the thread,power dissimilation --the essence of bribery as the important point, the paper puts forward its own study angles and methods on the present condition,contributing factors,and preventive measures of bribery, thus starts the prologue to the main body. The main body is divided into three chapters. Chapter 1 General Introduction to Bribery. First, this chapter reveals the different meanings of bribery from the different angles of criminal law and criminology.By using the study method of criminal law,this chapter proceeds with the characters of bribery and grasps the essence of bribery,i.e. the agent of power,as a medium,dissimilates the power into the common equivalent;thus a conclusion can be reached that bribery not only leads to the exchange of interest and power,but also creates the stern condition of rising and diversified means of bribery. Therefore we mustn't be softhearted towards bribery. We must take strong measures and precautions against bribery. This chapter tries to reveal this paper's research value,to draw forth the necessities and practical significance of studying the causes and prescription of bribery,thus pointing out the direction for the following two chapters, laying solid theoretical basis, and carrying a foreshadowing of what is to study on the following chapters. Chapter 2 Analyses of Contributing Factors of Bribery. Theory of crime causes is in the key position of theoretical system of criminal law. It is deeply related with all the theories of criminal law.It is the start point and basis of the whole theoretical system of criminal law.Doctors cure the sickness by finding out the causes first. In order to eradicate this kind of malignant tumour that threatens our society, the causes should be found out first.Having introduced different theories of the causes of bribery at home and abroad , the chapter proposes that bribery is the result of the united forces of subject,object,and circumstances,etc.Most of this chapter is devoted to the social and the subjective causes of bribery. In the section of the social causes, a series of factors have been analyzed, such as power negligence, economic dislocation, cultural misleading, behavioral illegality, especially the cultural waste matters that lull people's soul,just as "Wealth and rank come together", "Power not used in time will be overdue and invalid",etc.;all kinds of drawbacks that cause bribery in the present society are also distinctively pointed out. In the section of the subjunctive causes, special emphasis is laid on deep analysis of values,moral characters, psychological defense,etc.It provides theretical support for the next chapter, which mainly discusses strenthening and perfecting the system,mechanism and legality.
