In 1969,U.S Defense Department setup a computer network named ARPANET for the military purpose. There are 4 computers in it and it is the first network in the world. Thirty years past and the network have reached the scale of 80,000,000.The network developed so fast that our intellectual property legal system suffered huge impact. We are faced with a lot of blank and pending questions such as domain names and trademark, database protection, copyright of network etc. faced it, every lawyer must envisage it.In this master paper selection, I will select the question of domain names as my study aspect. This selection is based on hereinafter considering;The first, I studied computer in the Anhui University. Studying this question shows the advantage of knowledge background, further more, I am having strong interest on it.The second, legal studying provide theory sustain for the perfect and development of legal system. How to harmonize the development of science and technology and legal system innovation is hidden behind the question of domain names. And it is the center that we must focus on any time.The third, previously scholars' article laid particularly press on how to solve the conflict of domain names and the traditional intellectual property (especially trademark) and laid less press on domain names. It harms to the development of intellectual property law. In this article, I will emphases domain names' status in the law.There are 6 parts in this article. The first: Summarize, I will discuss the conflict of domain names and the traditional intellectual property.The second: Domain names' status in the law. I will get answer from the analyses of the character of intellectual property.The third: The protection of domain names. I will introduce some ways to111protect domain names, and stress on the administration procedure.The fourth: The International Private Law related to domain names. In this part, I will analyze some law principle used in the international intellectual property cases and analyze the advantages and shortcomings in domain names cases. Further more, I will prospect the future of international unified legislation.The fifth: domain names and reflection of intellectual property value. Through the analyses of domain names, I will reflect the value construction of intellectual property system and make it clear what intellectual property law should press on.The sixth: the end. Background and what I have learned from writing this article.
