The Financial Development In China Under The Trend Of Value Orientation Of Financial Law

In the present days when economy is ruled by laws, the development of finance can't live without the regulations and adjustments by laws, In this era when creation is everywhere, the finance organizations such as banks, bonds, insurance companies and trust companies are tending to intersect with each other. But the delaying nature of the present finance laws restrains the combination and expansion of various finance fields, and fetters competition and efficiency of the finance industry. The tendency, which is the combination, expansion and globalization of the finance industry, symbolizes the developing trend of international finance industry. It is also the inevitable trend of Chinese financing development. Under the background characteristics of times when Chinese finance opens to the world and our country joins into WTO, the practices of the combination, expansion and globalization of the finance industry surely will promote the reform of finance laws, and will initiate the revolution on the laws' value orientation. With the prerequisite of probing into the analysis and study of Chinese finance tendency, this article states the conflict that finance laws fall behind the practices of combining and expanding the financé fields, and explores to put forward the value orientation of financé laws and its realizing method. The whole article can be divided into three parts:PartⅠ:"The tendency and practices of Chinese finance's combination, expansion and globalization". On the basis of analyzing the present pros and cons of various Chinese finance fields, it puts forward the tendency of the combination, expansion and globalization of various financé fields, which is stated from both angles of theoretic reasons and practical basis. Also it introduces the beneficial explorations on the practices of that tendency.Part Ⅱ: "The constraint and influence of the present finance laws on the finance tendency of the combination, expansion and globalization". The article states the function of regulations and adjustments the laws played on economy and finance in the marketing laws, and analyzes the regulations of various finance fields through the present finance laws' key value and its influence on that tendency. It also illustrates the delaying nature of the present finance laws on reflecting that tendency and the open policy of finance, and the necessity of reforming it.Part Ⅲ :"The value orientation and realizing method of Chinese finance laws".The laws should be changed according the times. The tendency and practices of combination expansion and globalization of Chinese finance determine the direction of finance laws' value reform. The article puts forward and discusses that the value orientation of finance laws should reflect the reality and foretelling of the finance combination, expansion and globalization, embody the regulations and principles of the open policies of finance under the background of joining into WTO. It also explains that the reconstruction of finance laws should be realized through the tendency of changing finance policies into laws, changing finance supervision and management into ruling by laws, and internationalizing finance regulations.
