Marine Cargo Insurance "all Risks" Terms Of Legal Issues Related To Research

The dissertation takes one clause of Chinese marine insurance on thecarriage of goods........."All Risks" clause as the objective. It is the most popularused insurance clause in marine insurance. In the dissertation, the author compares "All Risks" clause not only with "Free From Particular Average (F.P.A)" dause and "With Particular Average (W.A.)" clause of People's Insurance Company of China (PICC), but also with the "A" clause of the Institute Cargo Insurance (ICC) of England. Based on the comparison, the author also gives some advices on the revision of Chinese "All Risks Clause".The dissertation consists of four chapters.The first chapter introduces some concepts that are related with the marine insurance on the carriage of goods and the history of "All Risks" clause. It is to help the readers to know some basic concepts of the concerned terms so that they can understand the thesis easier and better.The second chapter compares "All Risks" clause with "Free From Particular Average (F.P.A)" clause and "With Particular Average (W.A.)" clause of PICC. These three clauses are the main insurance clauses of marine insurance on the carriage of goods. By the comparison, the feature of "All Risks" will stand out.The third chapter compares "All Risks" clause with the "A" clause of the Institute Cargo Insurance (ICC) so that we can see the disadvantage of "All Risks" clause of PICC.Based on the above three chapter, in the fourth chapter, the author gives her own opinions and advices on the revision of "All Risks" Clause of PICC.Chinese present insurance clause can't match Chinese practice any more. It has prevented the development of Chinese carriage of goods by sea, so it's urgent to revise the insurance clause.
