The procedure verdict is a form of justice administration in criminal procedure,independent of criminal adjudication,which provides a procedure platform to control the abuse of rights and to carry through the saving of rights.lt functions mainly as the followingsrto realize the judicial review before using the power of investigation and judicial punishment after the power being abused;to control the abuse of faculta jurisdictions to a certain degree;to fulfill the saving of rights of suspected criminals and the accused;to improve the effectiveness of criminal precedure.The basic elements of procedure verdict are:the subjective of procedure verdict;the deadline and mode of procedure application,procedure argumentation,procedure defense;burden of proof,standard of proof,evidence rules;the saving of procedure verdict.The main problems existing in the contemporary procedure verdict of Chinese criminal procedure are:the verdict is narrowly carried out and lacks the nuclear judicial review system and endanger the party against the procedure twice.The thesis also deplores the impromentment of the procedure verdict.
