On The Construction Of Community Correction System

Under the background of criminal integration, non-imprisonment becomes one of the mainstreams in criminal judicial innovation, so the core genius of sentence-executing socialization has been broadcast widely. Based on the above theories, community-correction system forms the subject of this thesis. Opposite to imprisonment-correction, community-correction begins to replace the former and becomes dominant in west countries. However, in China, community-correction system is still at its initial stage. The author wants to arouse more and more attention to this system and so improve it in Chinese legal circumstance by writing this thesis.The thesis is composed of three central parts. The first part is about the conception and foundation of community-correction. By disclosing the shortcomings of imprisonment-correction, we can find out the practical foundation of community-correction; self-effacement humanism of criminal law and objective viewpoint establish its academic foundation. The practice of community-correction is the subject of the second part. After learning about foreign practice, we turn our steps to our own country. The emphasis of this part is "the problem existing in Chinese practice of community-correction". Because finding out the problems is the premise of solving them. The last part is to solve the problems. At first, we should speed up the legislation of community-correction and establish an elementary legal frame. Then we can improve it little by little from some primary aspects.
