Neighboring Relations System Research

The paper for master degree is mainly on the researching of neighboring relations institution. This paper consists of four sections. Sections 1: The basic theory of neighboring relations institution. At the beginning, the author introduces the conception of neighboring relations. Then, the author demonstrates the neighboring relations from the field of being used, characteristic of subject and object and so on. After that, the author demonstrates the differences between neighboring relations and servitude. Sections 2: The definition of the right and duty of neighboring relations. The right and duty of neighboring relations must be definitely bounded. When the right and duty of neighboring relations was bounded, it must be considered not only from the significance of economy, but also from the importance of morality. And then, the author discusses the content of the adjusting of traditional neighboring relations must be added. Sections 3: The brief introduction of foreign neighboring relations. First, the author introduces the neighboring relations contents and characteristic of Roman law, France civil law, German civil law, Japanese civil law and Switzerland civil law. Such as German's unmeasured damage institution and Japan's sun light damage hypothesis. Then, the author introduces the contents of Taiwan region neighboring relations institution. Sections 4: The suggestion on developing the institutions of the neighboring relation of our country. At the beginning, the author points out the deficiency of the institution of the neighboring relation of China. And then, the author states the embodiment that there lack the legal rules and regulations on adjusting of neighboring relations of China, and why. Finally, the author gives suggestions on how to improve the institutions of the neighboring relation of China.
