This paper discusses the formulation and its development of China'S law of mestic relation during the period from the law amending at the end of Qing ynasty to the promulgation of the Civil Law by the Nanj ing Kuomintang overnment.With the disintegration of China'S feudal system,the traditional Chinese aw system.which had lasted for thousands of years,gave way to the Western ourgeois law system.The law reforming and amending movement beginning from he end of Qing Dynasty continued after the establishment of the Republic of China.And with the promulgation and implementation of the Pandect of Six Laws by the anj ing Kuomintang Government,the transformation and modernization of China'S raditional law was finally completed.In the meantime,the Domestic Relation Chapter written in"the Civil Law of the Republic of China''marked the highest achievement in the development of China'S law of domestic relation in modem times. The research of modem law of domestic relation iS of both historic significance and current significance.Based on this knowledge,while giving in-depth analysis tothe course of making.fundamental contents and characteristics of modem law of domestic relation,suggestions will be made in how we can use this experience for reference to help our current marriage law construction. This paper iS composed of three chapters.The first chapter explains the origin cause and development of the formation of domestic law in the times of Republic of China.The chapter gives a review of the contents and characteristics of Chinese traditional 1aw of domestic relation.explains the cause of the formation of modem domestic law and introduces in detailits course of making.Chapter two describes the basic content of the Domestic Relation Chapter compiled in"the Civil Law of theRepublic of China"and how it transformed etailed introduction and analysis iS made he traditional system.In this chapter,to the domestic relation system,the arriage system and the family system in the domestic law of Republic of China.Chapter three deals with how we can use the domestic law of Republic of China for eference in our current marriage law construction.The inadequacy and vacancy of ur current marriage 1aw is pointed out in this final chapter,and at the same time some opinions on the revision of our current marriage and family law are expressed.
