Apart from the prelude and the conclusion, this article is divided into four parts concerning with the system of the Extended Producer's Responsibility (EPR) in the management of solid waste.Part One is the academic analysis of EPR. First, the article anatomizes the concept, the development and the characteristics of EPR. Then, the article discusses mainly about two legal basis of EPR: the environmental protection duties of enterprises and the theory of Life-Cycle Assessment. On the first theory, this article actually points out that it is reasonable and fair to impose economic burden including costs and expenses or restrict the routine production if only the reason is for the environmental protection. The moral duties of environmental protection can and shall be written into legal documents. During the discussion of the LCA theory, the LCA method which is of close relationship with EPR is the core.Part Two consists of two sections, namely legislations and practices, about the implement of EPR in the foreign countries. The author discusses about four aspects: the model of implement and the material methods, the varieties of the responsibilities, the economic burden and the take-back system. After summarize the characteristics of the implement of EPR, the author demonstrates her own thoughts and analysis of the problems of EPR. Such as: Whether on earth is EPR the Extended Producer's Responsibility or the Extended Product responsibility? What are the characteristics of these two responsibilities? How should we view the highly cost of the implement of EPR? How should we view the action of restricting free-trade in the name of environmental protection? At last, the author shows the conclusive implement constitutions of EPR in the Union Europe, the United States, Sweden, Germany and Japan to prove the before-mentioned conclusion.The third Part discusses mainly about the absence of EPR in China's legislation about solid waste. The author considers it fundamental to analyze the pollution characteristics and the conditions inside and outside our country before proper legislation.
