Study Of The Legal System Of Insurance Supervision

Insurance play decisive role in the economic and social development, which concerns the whole social stability and development. At present, Chinese insurance is in a rising and developing stage. Insurance is faced with the favorable circumstances. The political situation and economical condition from abroad and home, is beneficial to the development of the insurance. Meanwhile, it also confronts the new challenge. Especially, our government seriously keep its promise to the WTO, will go step further open the insurance market to the world. The business scope and managerial region of the foreign capital insurance company gradually expand, which will result in the new competition pattern of the insurance market. The domestic insurance will be up against the larger competitive pressure .In addition, the participant of the insurance market become many-faceted. Finally, financial market order and financial security will be significantly affected.With the rapid development and the great change, insurance market require a perfect and steady legal circumstances to ensure. Therefore, in the article, the author studied the theory and the present conditions concerning insurance regulation legal system from the perspective of the economic law, and made many suggestion.As for the article's structure, it includes four sections besides preface.Firstly, "the summary of insurance regulation". This section includes the concept and theory concerning insurance. On the basis of them, the author theoretically analyzed the necessity and feasibility of the insurance regulation by economic theory, and how to achieve the balance of the market and regulation.Secondly, "the insurance regulation legal system," in the section, the author distinguished the insurance regulative law from the civil law and commercial law, and categorized it in the economic law. Therefore, the legal task is clearly defined.Thirdly, "the system of the insurance regulation", in the section, the authorfound the difference between home and abroad through the commentary of the foreign system of insurance regulation.Finally, "the future of Chinese insurance regulation legal system", the section includes many specific suggestion order to complete the insurance regulation legal system. There are mainly three suggestion ,such as pay-ability regulation, the application of the insurance fund, the legal proposition of financial regulation system.
