Mediation System

China mediation culture has long standing history and been well established. It is an important form of settling disputes. However, the development of the system of mediation has weakened and can't keep pace with the development of the legal society.This paper has made a study of the Chinese mediation system. The paper attempts to give some suggestions on improving the mediation system in China through the analysis of history evolution and the discussion on the basic theory of mediation system.This paper will be divided into three parts. In the first part, the author introduces the historical resources and development proceeds of mediation and analyses the social sources which mediation exists and develops in China. The second part discusses the basic theory of mediation, including the conception of dispute, the types of mediation and the characteristics of mediation. In this part, author points out that the values of mediation as the will, efficiency, justice and peace. The third part is the most important part in the paper. In this part, the author studied the defects of our country's people's mediation and lawsuit mediation. Lastly, the author gives the suggestion on perfecting people's mediation and lawsuit mediation. We need to enforce the organization of people's mediation and promote the effect of the people's mediation agreement. For the lawsuit mediation, the procedure of mediation and judgment must be separated.
