Economic Law Nature Of Theory

The essence is something deep, coherent and stable of one thing, which decides the character and development direction of it. In the transforming period of social economy system, it is very important to research into the economic essence so as to help us understand relevant economic problems of economic law, push forwards the economic legality construction of our country and spread the conception of economic law.The author puts forward the viewpoint that we should make a comprehensive research of the essence of economic law from different perspectives and multiple aspects. The so called different perspectives mean that we need to study the essence of economic law from two different angles, the first is to study the general essential characteristics of economic law from the perspective that it is one part of whole legal system, the second is to study particular essence of economic law from the perspective that it is one independent subject. From the perspective of research of subject division, the study from the second is more important to the current situation and should be our main focus in our research on the economic law essence. The so called multiple aspects means that we need to study the economic law essence from three aspects, first, to research into the inner regulation of economic law from its own structure; second, to reveal the orientation of economic in value from the standard of economic law; third, to study the relationship between economic law and public law and private law and its practical significances from the outside relationship.As for contents the essence of economic law, the author holds the point of view that economic law is a law that helps to coordinate the national economic operation, which can help to realize the basic function of economic law in ourcountry. The economic law has social characteristics, which demands that the legislation of a county should fully embody fairness, justice and order in allocating the material interest among the different subjects of economic law. The economic law is public law in essence and it should not only fulfill the basic requirement of differentiating the public law and private law, but also the inner demand of economic market system, which has great significance in the transforming from planned economy to market economy, in strengthening and improving the rule of economic law and constructing a socialist country ruled of law.
