Space Rights And Related Legal Issues

With the development of industry ,the contradiction between the limition of city'land and the development of city become more and more serious.Using land three-dimensionally has become a world-wide trend and space right has been established in every state.So,space rightcan be established in many country.Space right is a new type of right ,it is de development of traditional theory,but there is nothing law about it in our country now,many confilts still exist . So these are just I will talk about in this paper.The paper includes five parts.Part 1 is the general introduction of space right system, includes its notion,classification and its content.Part 2 mainly introduces space rights of foreign countries ,they can be classified into three kinds:setting space right separately,stipulating space right in chapter of the Property Law .Part 3 is the core of this paper, introduces two opinions of character of space right ,whitch are affirmation and negation ,and expresses the author's standpoint and his reason.Part 4 analyzes the construction of space right and content of each part ,it also includes two points ,and the author expresses his opinion that we should establish ownership of space rights and analyses the reasons .Part 5 is also the core of this paper,introduces six aspects law problem about it .which are the establish of law, space right and the real estate right, the method of boundry of space ,the character and protection of contiguous rights of space,represent of space right in the Property Law.
