Fund Governance Structure Of The Perfecting Of The Governance Structure Of The Contract Funds In China

The first part of the abstract is about the intention of this paper, then it introduces the main content and the analysis frame of this paper. 1. the intention of this paper Fund is regarded as a popular way of combination investment in the current world. It has a history as long as more than 100 years since the Britain set up the " overseas and colony government's trust " in 1868. The fund industry in our country only has developed for over 10 years so far since the time when it started in 1991.However, it should be pointed out that the absence of the system at present of investment funds of our country made great problems, and to set up market-based fund governance structure is the most important aspect in perfecting fund governance and quickening the development of fund. The one that needs proving is, the research range of this paper is the governance structure of fund, not the governance structure of the fund management companies. The fund management company is only one of the fund parties, whose governance structure has no essential differences with that of general companies. There are already a large number of documents and research results in the relevant research of the governance structure of companies, but not many research and discussion on fund governance structure, especially on the fund governance structure of our country, so this paper mainly deals with the perfecting of fund governance structure and the governance structure of contratual fund of our country. 2. the main content and the analysis frame of this paper The first part introduces the brief development process of fund industry of our country. Then it probes into the similarities and differences of company's governance structure and fund governance structure further. And it briefly introduces the current research situation of company governance and fund governance both at home and abroad. The second part analyses the fund governance structure frame. It first analyses several problems that the fund governance structure should solve, which are problems on moral risk brought by fund contract and the fund parties' information asymmetry and reverse choice. Then it analyzes fund governance from three aspects: inside governance, outside governance and third party governance. And it proposes to solve the various problems in fund governance from the three aspects. The next part puts forward the criterion to appraises fund governance structure. The international comparison research carried on the fund governance structure is studied finally with investigation of the main fund governance structure mode in the west mature countries according to corporation fund and contractual fund separately. The third part analyses the existing problems of security investment fund of our country at present, and analyses the profound reasons behind it. The fourth part proposes to improve the contractual fund governance structure of our country from the three aspects of inside governance, outside governance and third party governance separately, which are based on the problems that the fund faces in our country in the third part of the paper.
