On The Construction Of The Mode Of Executive Compensation Legislation

The system on expropriation, confiscation and compensation was established in theconstitutional amendments made in March 2004, this has provided constitutional basisfor improving the related systems. For the time being, complete and regularadministrative compensation system has yet been established except some separateregulations on the administrative compensation in some single acts . A large amount ofproblems on compensation have no proper law to apply, which result in the loss of thelegitimate right and interest of citizens, legal persons and other organization due to"pubic interest" , such loss usually gets no compensation. The author of this articlediscusses the establishment of the legislative pattern on administrative compensation inChina on the basis of referring the domestic and international theory and system oncompensation.
