Research On Compensation For Administrative Expropriation

With the development of economy and citify of our nation, administrative expropriation question is entering legal sights of peoples. Its performance is unsealing houses in cities and the expropriation of collective lands in country. It relates vital interests of the peoples. The laws in this sphere are not paradigmatic. There are many contradictions in practice. If these problems are not solved well, the stability and development of our nation may be damaged.To solve these problems, one important measure is to establish reasonable institutions of compensation for administrative expropriation. The author aims at giving positive guide by researching on this problem. There are three parts in this article. In part one, the author introduced foundational theories on this problem. In part two, the value basis of compensation for administrative expropriation was disserted. They are realizing the equilibrium of interest and trying for social justice. Basic principles such as the equilibrium of interest and enough compensation were also disserted. In part three, the author designed institutions bybringing in the Game theory. The author pointed that full game was the best way. At last, some concrete measures were raised out.The article made analysis of law and economics. It offered a new thought to solve the problems of compensation for administrative expropriation.
