This paper discusses the "obligaziones ex delicta" in Roman law, and its characters, development and influences on the modern tort laws. The paper is divided into 3 parts. The first part expounds the delicta and obligaziones ex delicta. This paper introduces the two points of view to the "delicta" in Roman law, that is "delicta" or as one form of crimes, or as the cause of obligations. The latter is so called "obligaziones ex delicta". The second part concerns its systems,characters and development during the time of Roman law. From these three points, the author wants to not only describe its original feathers ,but also to tell the readers its "why". In the third part, for the purpose of illustrating its influences on the modern tort laws, the author lists those points in common and in difference in a comparative way. At the end of this paper, the author gets his conclusions: on one hand, the "obligaziones ex delicta" in the Roman law is very different from the modern tort laws, but on the other hand, the latter have gotten many influences from the former. Making it clear in which aspects and to what extent the former has influenced the latter is very useful to the studies of the modern tort laws.
