Although judicial expertise has a long history, as a part of the legal system construction it has only gradually developed with the development of the modern legal system. Presently, the judicial system plays an important role in worldwide legal systems and has become a foundation for promoting democracy in legal action and safeguarding judicial fairness. With the ever deepening concept of judicial fairness and the continuous implementation of China's judicial reform measures, much more will be expected from China's judicial system. History shows that development requires judicial reform, legal action democracy and judicial fairness. Therefore as China develops, China's judicial expertise reform is inevitable.The criminal justice system is an important part of the judicial system and plays an important role in criminal procedure. China's present criminal justice system was established in the 1950s and was characterized by a planned economy. The lack of a legal basis for many fundamental problems of judicial expertise has caused serious chaos in the setup of a judicial body and in the operation of the judicial system. Therefore the soundness and fairness of the system is impaired, hindering prompt case processing and proper application of laws and making judicial corruption possible. The objective of this paper is to find a way to construct China's judicial expertise system which is suitable and feasible for China's present situation. Beginning from a comparison study of the judicial system of the two great law systems, we attempt to put forward some suggestions on how to construct China's judicial expertise system by having a preliminary discussion on several aspects of controversial problems in the existing judicial system.
