Contemporary Chinese Judges, Professional Research

The judge is the executor and representative of state's law, meanwhile the occupation is the symbol of society conscience and justice. The occupation's speciality decided that a judge must possessed the special occupational ethics, consciousness, qualities, skills and position. So Judge's professionalism is the only way that our country moves towards government by law. And with the development of society, it also is the necessary trend and demand of social development. Undoubtedly building up the construction of Judge's professionalism will play a positive role to push up the modernization of the judicial system and the independence of judicial rights. This paper starts with the definition of essential feature and intension of judge's professionalism. And then it probed into the social conditions under which judge's professionalism exist and the necessity to implement judge's professionalism. Through summarizing the experience of western countries in this field and analyzing current situation of our country, the paper points out that in one hand, we not only need to set up a strict regulation which permit enrollment, perfect the continue education system, establish the uniform occupation moral criterion and supervisory and restricted system from the internal system; on the other hand, we must perfect the judicial environment, set up the security system and running mechanism of judge occupation with China's special feature from outer condition. Only integrating and combining with the two aspects, can we achieve the successful object of Judge's professionalism construction.
