Detainment, based on innocence deduction principle, is generally a kind of exceptional guarantee measure. However, it is not an exception but a normal condition in our state, which is characterized by deficiency in ratio principle, uncertain period, severely extended detainment, violation of neutrality principle of detainment place, lack of judicial examination and relief function. So regulations of unconvicted detainment are necessarily improved to form a dependent and closed judicial control system in our state.Concept and principles of unconvicted detainment are discussed in Chapter 1. Problems in unconvicted detainment regulations are analyzed jn Chapter 2, as well as conceptions and suggestions for development and improvement of unconvicted detainment regulations are put forward in Chapters. |
