Under the rules of WTO, the foundation of the government behavior norm is the modern market economic system. Although the modern market economy thrives on free market economy, government always behavior corresponds with the changes of the economic system. With the development of economic system and the ages, the social economic market system, once used to regulate the social economy in the capitalist society, began to show defects in terms of "Market failure" . The best way to deal with it is the government intervention that should be moderate, regarding the market as basis and government as aid. Along with the economic globalization and for the sake of more and more nations participating the economic market of the whole world, the World Trade Organization (WTO) came into being. The WTO principles are mainly to restrict the government behavior, it requests the members practice the market economy, regulate government administration and interfere the economic behavior within certain limits. The social economic market system is in some way a kind of legal economy system, but in our country the market economy system is not yet fully establishes and there are many problems concerning with government administration, lawmaking, legislation and judicature. China' s status in quo is far to meet the demands of WTO. To perfect China' s lawful government behavior, legal regulations should focus on legislation, executing the law and justice.
