This paper expound the fact in " marriage and family law " of our country shoulding establish and occupy system. Don't occupy and claim and live apart too, mean and remove couple obligation of living together without removing marriage legal system of relation only. Two marriage law make the regulation to this that our country issue since the foundation of the state will it be 1980 1950, marriage law amendment that issue have 2001 " because emotion get along well " regulation " to live apart all over two years, to the couple's right and obligation act as any regulation during occupying. Article combine social current situation and foreign legislative example of our country prove in our country setting up and occupy system imperative. The article has expounded first that does not occupy the theory summary of the system, through occupying the comparison of the system to every country origin, have proved the modern legislation current situation not occupying the system, set up possibility and necessity not occupying the system after probing into our country, put forward some elementary legislative suggestions on setting up occupying the system finally.
