This paper instends to study the methods of overcoming the unapparent rules by means of the theory analysis and practical analysis, and through recounting the cause, manifestation and functional hazarol about these rules. The author believes that:The nature of the unapparent rules is a kind of regulation system, which includes the unapparent rules as the same time. These rules are not only with the positive function, but also nogative function that cannot be neglected and could endanger the basia of law system.This two-opposing rules depend upon, conflict with, and under some special circumstances also covert each other.The unapparent rules are selected, limited and eliminated by judicial men who realize the relativity in between this two rules in judicial activity. And the hazards of the unapparent rules should be canceled in highest measure through reforming systems and reconstructing regulations, so as to build the lagal system society.
