Value Judgment Of China's Anti-monopoly Legislation

Starting from the present situation of anti-monopoly legislation in our country, this thesis analyzes the necessity of anti-monopoly from the aspects of economics and jurisprudence, and mainly elaborates the value of anti-monopoly law and the institutional design of anti-monopoly law in our country in the future. The author regards the competitive value, the value of the economic freedom, the value of economic efficiency as the special value of anti-monopoly law and discusses them in detail. By comparing the legislation mode of different countries, the thesis advocates introducing the experience of other countries for reference and meanwhile emphasizes that anti-monopoly legislation of our country should be adapted according to the specific condition of our country. Finally the thesis considers that the value of law can be embodied only by specific legal system, otherwise, the legal system is the method of achieving the value of law.
