Domain Name Dispute Resolution A Number Of Legal Issues

In the intellectual-economy-times, in which Internet becomes significant mark, Internet will be important basis of society. And now, Internet has become the biggest information network.The network developed so fast that our intellectual property legal system suffered huge challenge, especially which from Domain Name.In my master paper ,I will study Domain Name and will focus on how to settle disputes about Domain Name.There are eight parts in this article.The first:Introduction. In this part, I will mostly clarify the importance of Domain Name and the complexity of disputes about Domain Name. Then ,I will give a summarize of chief academic points about Domain Name .The second:Chapter 1. In this part,I will do the research ab out the basic issues of Domain Name, including the definition, fu notion,feature, classification.The third: Chapter 2. In this part, I put the emphasis on the research of the nature about the right of Domain Name , for to clarify the nature is precondition to settle disputes. And I will also discuss how to protect Domain Name from the aspect of law. Through series of analysis, at last I get the conclusion that we should protect Domain Name as a new and separate intellectual property.The forth: Chapter 3. In this part, I will discuss types of Domain Name disputes to put the basis for settling problems.There are eight kinds of disputes, including which between trademark and Domain Name, Domain Name and Domain Name, Domain Name and business name, Domain Name and website name, Domain Name and name of famous person, Domain Name and famous geographical name, Domain Name and pertinent intelltual property of international organization, Domain Name and name of business-unit in our country.The fifth: Chapter 4. In this part, I will introduce the international legislation about diputes settling of Domain Name.At last,I"ll get the enlightening guidance for the legislation of our courty.The sixth: Chapter 5. In this part, I will expound the application of law about disputes settling Of Domain Name, such law as Trade Mark Law, Cival Law,Anti-Unlawfully Competing Law, etc.The seventh: Chapter 6. In this part, I will discuss the settling ways of tortious disputes about Domain Name, especially how to make judgement about a kind of tortious act. Furthermore, I will also dicuss other ways to resolve disputes, including the Dispute Resolution Policy of CIETAC, reconciliation, arbitration.The eighth: Chapter 7. In this part,I will discuss the reason how right conflicts about Domain Name arise and I will also make an inquiry into ways of settling those right conflicts .
