Timsharing, as a new way of tourist consumption, originated from The Alpsarea of France. It spread quickly later on Europe, and get a faster development in theUnited States, currently, Timsharing has already became a range of recreationalholidays which has been the rage all over the world, mainly taking the Europeanmode and the American mode as a representative in its business model. Timsharinghas been spread into China in recent years and gradually developed into two types:one is buying ownership rights, the other is buying right of use. The problem ofTimsharing mainly review from two angles of the theories and actual situation. Intheories part, discuss the law problem of the timsharing of the ownership right andthe timsharing of leasehold. Ownership rights kind of timesharing is a special formof owners-hip rights and can be supposed as time-limited or term-limited ownershiprights. It's legal characteristic is absoluteness-weakened, exclusion-limited,time-limited, integrative, register-declared and major identity of rights dimensional.This kind of ownership rights is a development and improvement of the theory oftraditional ones. The timsharing of leasehold possesses the legal characteristics ofdominion, usufruct, independency and possession. As a tourist product, it's self-legalcharacteristic is major identity of rights dimensional, double time-limited,register-declared , therefore, this type of right is regarded as an independent right ofusfructus. The emergence of the timsharing of leasehold carried on introspecting tothe real right legal principle. In actual situation part, starting with analyzing twocases, analyzing currently the existent problem of timsharing in our country and putforward the lawmaking thinking and suggestion of regulating timsharing.
