| With the increasingly wide use of the technology of Genetically ModifiedOrganisms (GMOs) in our daily life, its negative effect becomes more and moreobvious. However, many countries and regions in the world only focus on theprocedure for examination and approval and the civil liability of the environmentaltort has been overlooked. Legal liability is the core issue of legal system, and all therights and obligations set by law are just hollow if without legal liability. Also inenvironmental tort law, every possible material has its own characteristics;sospecialized legislation is necessary in this field. In addition, the dispute ininternational trade has the trend to worsen because of the different legal systemamong countries, so the purpose of this thesis is to attract attention to this field.There are five parts in this article. The first part is the summary of environmentaltort caused by GMOs and current legislation regulating this field in EU and USA. Thesecond part is about the general introduction and comparison of civil liability ofenvironmental tort caused by GMOs in EU and its member countries. The third part isthe introduction of legal system of civil liability of environmental tort caused byGMOs in the U.S. The forth part is about the coordination effect of internationalconvention. The fifth part is the author's own opinion according to the aboveintroduction from six aspects. |
