Cyberspace Jurisdictional Issues To Explore

With the fast development of computer science and the abroad exercise of Internet technology, a new Internet information era is coming. Anyone with access to the Internet anywhere in the world can easily access and interact with the World Wide Web. In the mean time, our law system and social rules are being changed by this technical revolution, as greatly as the Industry Revolution had done in that time. With the development of Internet , many problems appear included economic problems and law disputes, such as electronic-contract,payment on internet,Cyber-Jurisdiction,intellectual property right,international revenue on internet and so on. With the increase of electronic commerce cases, more and more country begin to attach importance to the problem about Cyber-Jurisdiction. Therefore, it is very necessary to revise those rules, so they can be applied to the Cyber Space.The thesis is divided into five parts. In the first part, the thesis makes a brief introduce about the history and characters of internet. In the second part, the writer concludes the theory of jurisdiction. then introduces theory of jurisdiction in common law and in civil law emphatically. In the third part, on the base of full understanding of theory of jurisdiction in different nations, the writer analyzes the challenges that internet plays on traditional international jurisdiction. In the fourth part, in the comparative method of studying and on the ground of case analysis, the writer presents and reviews several applicable ways to define the jurisdiction on the background of Internet. In the last part, with the analysis of correlative examples and law constructions in our country, some suggestions are made for the legislation of our country on the jurisdiction in Cyber Space.Through this dissertation, the writer hopes, the primary realization of the Cyber Space-jurisdiction from both theory and practice will be given. And this dissertation guide the development of the legislation and justice practice in our country.
