Legal Construction Of China's Personal Credit Institutions

Credit is the basic principle in the communication of human society. Moreover, personal credit is on the foundational position of entire society credit system. With the rapid development of China's economy, the lack of personal credit is becoming one of the most important obstacles which seriously influence the development of economy and advancement of the society.Presently, China face lots of questions during the process of establishing personal credit system, such as what's the interior and exterior meanings of"Credit","Credit Investigation"etc., how to start up to build the personal credit investigation system, what kind of credit investigation model should China choice, how to protect right of privacy etc.. This dissertation is to give a clear analysis of the above-mentioned questions and try to find out a reasonable way to establish and develop the personal credit information registry in China so as to make some contributions to the development of China's credit investigation industry.Firstly, the dissertation defined several terms of"credit","credit investigation","personal credit information registry"etc. so that the object and scope of research could be confirmed.Secondly, the dissertation analyzed the functions of credit information registry and explained the necessity and rationality of developing personal credit investigation institute in China.Thirdly, the dissertation introduced three mature personal credit information registries out of China, namely American model, European model and Japanese model. To understand there three different personal credit information registries, the dissertation tried to analyze and compare them from aspects of operation characteristic and credit legal system etc.
